Acceptance
This End User License Agreement ("EULA") governs the terms of use of the Software, its updates, and related services provided by the Licensor. Downloading, installing, or otherwise using the Software constitutes the User’s unconditional acceptance of and agreement to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use the Software.
1. Grant and scope of license
1.1 The Licensor grants the User a perpetual, non-exclusive, non-transferable, and non-assignable license to install and use the Software for internal business purposes or personal use.
1.2 One purchased license authorizes the User to install and use the Software within one (1) production PrestaShop installation (defined as a single instance of the software operating on a shared database).
1.3 If the PrestaShop Multistore feature is used within the same single installation and shared database, a single license covers all shops and domain names configured within that specific installation. Deploying the Software on a separate, independent PrestaShop installation requires the purchase of an additional license.
1.4 The User is permitted to install one additional copy of the Software on a non-production testing environment (development / staging / localhost) associated with the production installation, provided that such environment is not publicly accessible to end customers and is used strictly for development, testing, or staging purposes.
1.5 The User shall not, directly or indirectly: (a) sell, resell, rent, lease, sublicense, distribute, or otherwise transfer the Software to third parties; (b) reverse engineer, decompile, disassemble, or create derivative works for public redistribution or resale; (c) remove, alter, disable, or circumvent any copyright notices, proprietary markings, or attribution labels within the Software.
1.6 License transfer (assignment): the Licensee may make a one-time, permanent transfer of all rights under the purchased license to a third party (new Licensee), provided that: (a) the transfer includes the license in its entirety, along with all copies and backups; (b) prior to the transfer, the original Licensee permanently uninstalls and deletes the Software from all environments and servers; (c) the new Licensee expressly agrees to be bound by the terms of this EULA. Any subleasing, partial resale, or continued use of the Software by the original Licensee following the transfer is strictly prohibited and constitutes copyright infringement.
2. Intellectual property rights
2.1 All title, copyright, intellectual property rights, and proprietary rights in and to the Software, its source code, visual components, databases, text, media, and documentation belong exclusively to VEKIA.PL Miłosz Myszczuk. The Software is protected by national and international copyright laws and treaties.
2.2 This EULA does not transfer any proprietary or intellectual property rights to the User, granting only a limited right to use the Software under the terms set forth herein.
3. Update policy and technical support
3.1 Purchase of a license entitles the User to 12 (twelve) months of access to Software updates, calculated from the date of purchase.
3.2 During the active update access period, the User is entitled to complimentary, remote technical support via email under the terms outlined in the Terms of Service.
3.3 Following the expiration of the 12-month period, the User retains the right to use the previously downloaded version of the Software perpetually, but loses access to new releases, security patches, and technical support until the update subscription is renewed.
3.4 The Licensor reserves the right to discontinue support for legacy versions of the Software that are no longer compatible with officially supported PrestaShop or PHP versions.
4. Responsible disclosure policy
4.1 The Licensor adheres to a Responsible Disclosure process for security vulnerabilities. Users who identify a potential Security Vulnerability are required to report it promptly and confidentially to [email protected] prior to any public disclosure.
4.2 Upon receipt of a valid security report, the Licensor will perform technical verification and, upon confirming the defect, will make reasonable efforts to develop and release a security fix (Update) within its regular release cycle.
4.3 The User strictly agrees to maintain confidentiality and refrain from publicly disclosing information regarding the vulnerability, attack vectors, or exploit code until an official patch has been published by the Licensor.
5. User security obligations (shared responsibility)
5.1 The User acknowledges that software security is a shared responsibility. The User assumes sole responsibility for: (a) maintaining a secure and isolated server environment, including the deployment of Web Application Firewalls (WAF), firewall rules, and access control lists; (b) enforcing strong, unique passwords and two-factor authentication (2FA); (c) restricting administrative panel access strictly to authorized personnel; (d) performing regular, verified backups of all files and databases; (e) promptly installing all available updates for PrestaShop, PHP, the Software, and all third-party modules; (f) monitoring server logs and security alerts for suspicious activity or unauthorized access attempts; (g) ensuring proper server and database configuration and hardening; (h) complying with all applicable data protection laws and regulations (including GDPR); (i) ensuring compatibility between the Software and the User’s specific server, PHP, and PrestaShop environment.
5.2 The User acknowledges that the Software is merely one component of a broader e-commerce architecture, and overall security depends on the proper hardening, digital hygiene, and maintenance of all system elements.
6. Disclaimer of warranties (as-is)
